A New(ish) Model for Startup Legal Services

November 3, 2014 by Harry Joiner - Add Comment
I hear a lot of chatter these days about how startups should use lawyers as advisors and not crisis managers. The reasoning is obvious: when lawyers are consulted, regularly, they are able to spot issues before they become intractable problems and minimize financial exposure. But it’s hard to persuade cash-strapped small businesses to assume a certain cost now to avoid an uncertain one down the murky road. Source: Technology

How Smart Investors Can Profit Safely with 'Riskier' Stocks

November 3, 2014 by Harry Joiner - Add Comment
Filed under: Investing Kurt Kleemann/Shutterstock If you’re like most investors, you are using a broker or investment adviser who is recommending some or all of the following: Market timing. Individual stocks or bonds. Actively managed mutual funds, where the fund manager attempts to beat a designated benchmark, such as the S&P 500 (^GPSC). Alternative investments. Variable annuities. Equity indexed annuities. Private equity deals. Principal protected notes. Currency trading. Commodities trading. As Dr. Phil would say: How’s that working for you? Apparently, not well. Has The Bank Of Japan Started Another Round Of Central Bank Wargames?

November 1, 2014 by Harry Joiner - Add Comment
Never pick a fight with a central bank. The only one who gets hurt is you. Unless, of course, you are another central bank. Central banks routinely intervene in the markets to influence the prices of assets, commodities and currencies. That’s the way monetary policy is conducted. It’s the principle behind QE. Generally, everyone co-operates. When a central bank announces that it intends to buy assets, investors queue up to sell – even though they presumably have optimized their asset portfolios. Some of those who opt to sell to a central bank would no doubt have sold anyway. Others perhaps [...]

The Week Ahead: Why Stocks Must Get Even Stronger

October 31, 2014 by Harry Joiner - Add Comment
The impressive rally from the October 15-16 lows looks ready to push the S&P 500 and Dow Industrials up close to 2% for the month. The strength and relentless nature of the rally has surprised many, especially those who were looking for a new bear market. The negative technical divergences at the early September highs warned of a correction, which I thought would be a buying opportunity. The decline was sharper than I expected so, in my early October column Will the October Curse Spook Investors Again? I wondered whether we would see even more panic selling. On October 15, [...]

Small-Caps, Big Volume

October 31, 2014 by Harry Joiner - Add Comment
The FOMC announcement had few surprises though some saw hints that that improvement in the economy could mean they will move rates higher than expected. The losses were minor as the oil service, banks, and semiconductors were able to move higher. Though most of the Asian markets were higher, the selling overseas is fairly strong with the German Dax down over 1.3%. The futures are just barely higher ahead of the 3rd quarter GDP data?which came in at 3.5%?which was above estimates of 3.1%.
